Please read these Terms of Service (“Terms”, “Agreement”) carefully before accessing or using our website, purchasing products, or utilizing any services provided by Materia Research. By accessing the website, checking any agreement boxes, or placing an order, you (“Buyer,” “Customer,” “User”) agree to be bound legally by these Terms, including our strict Research Use Only (RUO) policy.

If you do not agree to all terms and conditions of this Agreement, you are prohibited from accessing the website or using any of our services.

1. Eligibility & Age Verification

  1. Age Requirement: You must be at least twenty-one (21) years of age (or the age of majority in your legal jurisdiction, whichever is greater) to access this website, purchase products, or create an account.
  2. Representations: By placing an order or navigating this Site, you represent and warrant that:
    • You meet the minimum age requirement of 21 years.
    • You have full legal authority and capacity to enter into a binding contract.
    • You are an institutional researcher, qualified scientist, laboratory professional, or authorized representative buying strictly on behalf of a legitimate research endeavor.
  3. Right to Refuse: We reserve the right to demand age and credentials verification at any time and may refuse service, terminate accounts, or cancel orders immediately if we suspect non-compliance.

2. Strict “Research Use Only” (RUO) Declaration

  1. In Vitro & Laboratory Use: All chemical compounds, peptides, and products offered by Materia Research are sold strictly for laboratory research, analytical, and R&D purposes only.
  2. Prohibition of Human/Veterinary Consumption: Products sold on this website are NOT for human or animal consumption of any kind. They are strictly prohibited from being used as:
    • Prescription or non-prescription drugs, therapeutics, or pharmaceuticals.
    • Food additives, dietary supplements, cosmetics, or medical devices.
    • Diagnostic, clinical, or therapeutic applications.
  3. FDA & Regulatory Disclaimer: The statements made on this website have not been evaluated by the U.S. Food and Drug Administration (FDA). The products listed are not intended to diagnose, treat, cure, mitigate, or prevent any disease, medical condition, or physiological state.

3. Buyer Warranties, Handling, & Buyer Risk

  1. Buyer Qualifications: The Buyer acknowledges that products may be hazardous if handled improperly. The Buyer warrants that they possess the necessary equipment, safety protocols, and qualified personnel to safely handle, store, and dispose of chemical reagents.
  2. Assumption of Risk: The Buyer assumes all risks, liabilities, and responsibilities associated with the receipt, storage, handling, research, and disposal of all products purchased from Materia Research.
  3. Misuse & Immediate Order Cancellation: If Materia Research has reasonable grounds to suspect that a customer intends to use products for human consumption, animal testing, or illegal purposes, we reserve the right to cancel the order immediately, reject future sales, and blacklist the customer account without prior notice.

4. Orders, Pricing, & Payment Terms

  1. Order Acceptance: Placement of an order does not constitute final acceptance. We reserve the right to cancel or limit order quantities at our sole discretion.
  2. Pricing: All prices listed are in USD unless stated otherwise. Prices, availability, and promotional terms are subject to change without notice.
  3. Payment Methods: Payments are processed via secure credit card gateways or approved alternative payment options (such as select cryptocurrencies). You agree to provide current, complete, and accurate purchase and account information.

5. Shipping & International Compliance

  1. Dispatched Location: Orders are processed and dispatched from facilities within the United States.
  2. Legal Compliance in Destination Jurisdiction: It is the sole responsibility of the Buyer to ensure that importing, receiving, and possessing the ordered chemicals strictly complies with all local, state, federal, and international laws or regulations within their jurisdiction.
  3. Customs, Seizures, and Import Duties: Materia Research is not liable for packages confiscated, delayed, destroyed, or taxed by customs agencies or regulatory bodies due to local regulatory restrictions.

6. Return Policy & Order Issues

  1. Final Sale: Due to the regulatory nature, temperature requirements, and safety protocols surrounding laboratory-grade research chemicals, all sales are final. We do not accept returns or exchanges for unwanted products.
  2. Damaged or Incorrect Orders: If an item arrives damaged or incorrect, you must report it to support@materiaresearch.com within 48 hours of delivery. Claims must include clear photographic evidence of the unopened, damaged package and batch numbers. Valid claims will be eligible for a replacement or store credit at our discretion.

7. Intellectual Property & Site Usage

  1. Ownership: All contents of this Site—including graphics, branding, text, code, product names, logos, COAs, and design—are the intellectual property of JOMECH LLC / Materia Research and are protected under trade dress, copyright, and trademark laws.
  2. Prohibited Activities: You may not reproduce, duplicate, copy, sell, scrape, extract, or exploit any portion of the Site without express written consent from Materia Research. Unlawful access via automated bots, crawlers, or security breaches is strictly forbidden.

8. Disclaimer of Warranties & Limitation of Liability

  3. Maximum Liability: OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR PRODUCTS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

Jurisdiction & Venue: Any legal suit, action, or proceeding arising out of or related to these Terms or purchases made on this website shall be instituted exclusively in the state or federal courts located in Contra Costa County, California, and you irrevocably consent to the jurisdiction of such courts.
